These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and AppCraft Studios (Pty) Ltd ("Company", "we", "us", or "our"), governing your access to and use of the FinYang AI software platform, website located at finyang.net, and associated software applications (collectively, the "Service").

By creating an account, uploading documents, or accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.

2. Description of the Service

FinYang AI is a cloud-based financial intelligence and bank statement analysis software-as-a-service (SaaS) application. The platform provides automated document parsing, verified ledger reconstruction, cash-flow metrics, category breakdowns, and AI-assisted financial synthesis.

No Financial or Credit Advice: FinYang AI provides computational analysis and productivity tools for informational purposes only. FinYang AI is not a registered financial advisor, accounting firm, bank, credit bureau, or lender. The analytics and summaries generated do not constitute formal auditing, investment advice, credit underwriting, or legal counsel. You remain solely responsible for verifying the accuracy and appropriateness of all financial records and decisions.

3. Account Registration & Security

To access full features of FinYang AI, you must register for an account using a valid email address or authenticated identity provider. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security and confidentiality of your login credentials.
• Promptly notify us at support@appcraftstudios.com if you suspect any unauthorized access to your account.
• Accept full responsibility for all activities conducted under your account.

4. Subscriptions, Payments & Delivery

FinYang AI offers free evaluation access and paid recurring subscription plans (such as Pro and Max tiers) as detailed on our Pricing page.

• Digital Delivery: Access to paid subscription features and increased processing quotas is delivered immediately upon successful transaction completion.
• Billing Cycle: Subscriptions are billed in advance on a recurring monthly or annual basis, depending on your selected billing term.
• Payment Processing: Payments are securely handled through our authorized payment processors and Merchant of Record partners (e.g., Paddle, Paystack). You authorize recurring charges to your selected payment method until cancellation.
• Taxes: Fees are exclusive of applicable local taxes (such as VAT, GST, or sales tax), which will be calculated and displayed at checkout according to your jurisdiction.

5. Cancellation & Refund Policy

You may cancel your subscription at any time via your self-service account dashboard or by contacting our support team. Cancellation prevents future billing at the conclusion of your current paid billing period.

6. User Content & Data Ownership

You retain all ownership rights to any bank statements, financial documents, files, or information you upload to FinYang AI ("User Content").

By uploading User Content, you grant the Company a limited, secure license strictly to process, analyze, and display your data within your authorized account. We do not sell your data, use your private bank statements to train public machine learning models, or disclose your financial records to third parties except as required to provide the Service.

7. Acceptable Use Policy

You agree not to use FinYang AI to:

• Upload fraudulent, forged, or unlawfully obtained bank statements or documents.
• Infringe upon the intellectual property, privacy, or legal rights of any person or organization.
• Attempt to decompile, reverse-engineer, disassemble, or extract source code from the platform.
• Interfere with, overload, or disrupt the integrity or performance of the servers, networks, or API endpoints.
• Circumvent account quota limits, security controls, or billing mechanisms.

8. Intellectual Property

The FinYang AI name, brand marks, software code, user interface designs, mathematical algorithms, documentation, and visual styling are the exclusive property of AppCraft Studios (Pty) Ltd and its licensors, protected by international copyright, trademark, and intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by applicable law, AppCraft Studios (Pty) Ltd, its directors, employees, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data loss, business interruption, or financial miscalculations resulting from reliance on automated statement parsing or AI-generated analytics.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

10. Governing Law & Jurisdiction

These Terms and any dispute arising from your use of the Service shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles. Any legal proceedings shall be subject to the jurisdiction of the competent courts of South Africa.
